With the decisions published on 19.09.2018 and 07.12.2018 on the Turkish Official Gazette, some regulations regarding the transition of foreigners to Turkish citizenship changed. Turkish citizenship will be given directly to foreigners who buy at least 250.000 USD of real estate in Turkey and who give a commitment to buy a property worth of 250.000 USD from the notary.

A DECISION TO AMEND THE APPLICATION OF THE TURKISH CITIZENSHIP GRANTING LAW

Article 1

  • The Law relating to the Turkish citizenship in force has been amended in accordance with the Council of Minister’s decision dated 11/2/2010, No. 1/2010/2010.
  • By amending the term “as requested by the Council of Ministers and the Minister” in Article 20 of the Law, with the term “as requested by the President of the Republic”.
  • And amending the terms in item (a) of the same paragraph, instead of the term “2,000,000 USD” “Ministry of Economy” terms “500,000 USD or what equals in Turkish Lira” “Ministry of Industry and Technologies “… are put.
  • And amending the terms in item (b), Instead of the term “1,000,000 USD” the term “250,000 USD or equivalent in Turkish Lira”.
  • And amending the terms in item (c) Instead of the term “100” “Ministry of Labor and Social Security” the term “50” is put in order “Ministry of Labor and Social Security”.
  • And amending the terms in item (ç) Instead of “3,000,000 USD” “Treasury Advisory” terms “500,000 or equivalent to Turkish Lira” “Ministry of Treasury and Finance” are put.
  • And amending the term (d) in this way: “Foreign currency of at least 500,000 USD or at least what equals this amount of money, or a real estate investment equivalent to that amount, or capital investment provided that this investment is to be maintained for at least three years, and verifying that by the Capital Markets Authority.”

The resolution was issued in accordance with article 46 of the Turkish Nationality Law No. 5901 concerning the amendment of the decree applied in the law mentioned below concerning the granting of Turkish nationality and comes into force immediately.

Decree on amendments to the Turkish Citizenship Act

  • Article (1) Article (b) of the second paragraph of the decree concerning the application of the Turkish nationality law and within the scope of application was added in accordance with the decision issued by the Council of Ministers on 11/02/2010 No. 2010/139, By adding a phrase after the words ” Which he bought “, the phrase ” Either be a full title deed or a floor easement “, so that the property is paid in cash at a value not less than $ 250,000 or the equivalent in Turkish lira, and organizing a promise to sell contract at notary and put an additional explanation on the title of the property shows that the property cannot be sold or transferred to another party for three years.
  • Article 2 This Decree shall enter into force as from the date of its publication.
  • Article 3 The President of the Republic shall implement the provisions of this decree.

Directed to: Tabu and Survey Real Estate Directorates in the regions

Personal identification documents, or foreign passports, should be the basis for personal identification in title deed transactions for real persons of foreign nationality. Provided that such documents are granted to them by the competent authorities of the countries to which they belong.

For citizens of the State of Palestine in particular, the identity documents and passports granted to them from other countries (such as refugee travel documents, etc.) are accepted without the need to provide identification documents and passports issued by their country of origin.

If the Palestinian nationality holder is submitted with the residence permit issued by the Directorate General of Turkish Immigration, the Turkish ID number for foreigners should be written in the field of the foreign identity number in the electronic transaction called TAKBİS (which can be obtained from e-Devlet, Tabu, and real estate survey).

If the TC number is not available, you must type the passport number or foreign state identification number.

If the document is written in non-Latin characters, the Tabu Directorate may request translation of identity card or foreign passport (amended by approval No. 1058120 dated 06/03/2019).

As for stateless persons (without nationality), they will use the Turkish residence card mentioned in the above documents: in the place of identity card or passport (under the amendment made by decision No. 1058120 dated 6/3/2019), and a special search and investigation of the personal identity of stateless persons, granted to them by the State Administration, will be conducted under article 50/2 of the Foreigners and International Protection Act No. 6458.
